All intellectual property rights (including but not limited to copyright, trademarks, registered and unregistered designs, database rights, domain names and goodwill in all content included on this website and in LYST, including all text, graphics, logos, photographs and images) are the exclusive property of Lyst Ltd and its affiliates (“Lyst”) or its licensors and are protected by applicable legislation around the world. Any commercial use, including the reproduction, modification, distribution and transmission of any content is strictly prohibited without the prior written consent of Lyst.

“LYST” is a registered trademark in Australia with registration number: 1653336.

“LYST” is a registered trademark in the United States with registration number: 5045749.

“LYST” is a registered trademark in the European Union with registration numbers: 10840321 and 1383624.

Lyst also owns trademark registrations for “LYST” and other LYST-formative marks in China, Hong Kong, Japan, Russia, Singapore, South Korea, and Switzerland, as well as a pending trademark application for the “LYST” mark in Canada.

Lyst has a reputation for providing a high-quality fashion e-commerce platform. Lyst’s trademarks are important corporate assets and Lyst requires that they be used only with Lyst’s written permission and both lawfully and properly. To uphold its reputation and protect its trademarks, Lyst diligently guards against any trademark violations.

Intellectual Property complaints

Lyst strives to ensure full compliance with intellectual property laws and to ensure that listed items do not infringe the intellectual property of third parties. However, in accordance with our intellectual property policy, if you wish to make a complaint regarding alleged infringement then please follow the relevant guidance below to allow us to investigate, assess and respond to your complaint.

Trademark complaint

  • Report your trademark complaint in writing and identify any relevant registration/application numbers, the registration country and the owner;
  • provide your complete contact information (full name, postal address, email address and phone number);
  • provide a description of the content on our site that you claim infringes a trade mark and information reasonably sufficient to permit us to locate the material on our website (e.g. URLs and screenshots);
  • give a description of how the trademark is allegedly infringed;
  • provide an electronic or physical signature confirming you act on behalf of the trademark owner; and
  • attach files relevant to your request.

Other Intellectual Property complaints

Copyright complaint

  • Report your allegation of copyright infringement in writing to the Lyst Copyright Agent identified below;
  • include a description of the copyrighted work that is claimed to have been infringed, and a description of the content on our site that you claim infringes your copyright;
  • provide information reasonably sufficient to permit us to locate the material on our site (e.g. URLs and screenshots);
  • provide complete contact information (full name, postal address and phone number);
  • provide an electronic or physical signature confirming that you are the owner of an exclusive right or are authorised to act on behalf of the owner; and
  • provide a statement that:
    • you have a good faith belief that use of the copyrighted content described, in the manner complained of, is not authorised by the copyright owner, its agent, or the law;
    • the information in the complaint is accurate; and
    • under penalty of perjury, you are the owner or authorised to act on behalf of the owner of an exclusive copyright that is allegedly infringed.

Lyst may request additional information before removing any allegedly infringing material. In the event Lyst removes the allegedly infringing materials, Lyst will immediately notify the person responsible for posting such materials. Lyst may also provide the responsible person with your email address so that the person may respond to your allegations.

These policies and procedures have been drawn up in the English language. In case of discrepancies between the English text version of these policies and procedures and any translation, the English version shall prevail.
